Using Sound Recordings
COMMERCIAL SOUND RECORDINGS
Provide the full citation—in the style that you prefer your students to use—for the sound recording that you have selected. For example (in APA style): Pablo, A. (1999). Valley of Jehosaphat [CD] Washington, D.C. : Ras Records. (To comply with the TEACH ACT, all materials must be fully cited each time you assign or use them.) Add a copyright notice, Copyright © 1999 Ras Records, and a disclaimer:
The copyright law of the United States (Title 17, United States Code) governs the reproduction of copyrighted materials. Under certain conditions specified in the law, university libraries and archives are authorized to provide reproductions. One of these specified conditions is that the reproduction be used for academic study, scholarship, or research only. This material has been made available solely for use in this course. The material may not be distributed to any person outside this class, electronically or in paper form without specific permission from the copyright holder. If you use a reproduction for purposes in excess of fair use without permission, you may be liable for copyright infringement. Further, circumvention of technological protection measures (Section 1201) is against the law.

If Whitman owns the commercial audio recording:
YOU MAY:
- Play the recording for your students in a face-to-face situation.
- Ask library staff to place the item on Course Reserves.
- Ask your students to listen to the recording in the Music Listening Library or access the resources available through Penrose Library.
YOU MAY NOT:
- Copy the recording to any tangible medium or digital medium and use it outside the physical or digital classroom and/or distribute it without specific permission from the copyright holder.
- Copy the recording to a downloadable file without specific permission from the copyright holder.
- Stream or place on your CLEo page an illegal copy or recording.
If Whitman does NOT own the commercial audio recording:
YOU MAY:
- Ask the Music Department (music) or Collection Management librarian (spoken word) to purchase a copy for the collection.
- If a copy cannot be purchased, or it has not arrived on time, you may place your own legal copy on Course Reserves for your students to borrow.
- Play the recording for your students in a face-to-face situation.
YOU MAY NOT:
- Copy the recording to any tangible medium or digital medium and use it outside the physical or digital classroom and/or distribute it without specific permission from the copyright holder.

- Copy the recording to a downloadable file without specific permission from the copyright holder.

- Use the recordings against the performers’ wishes.
